1. Purpose and acceptance
These Terms and Conditions govern access to and use of the cupriax.cl website (the Site), owned and operated by Cupriax SpA (CuprIAx), whose identifying details are set out above.
Accessing and using the Site implies full and unreserved acceptance of these Terms and Conditions as published at the time of access. If you do not agree with them, please refrain from using the Site.
2. Use of the Site
The purpose of the Site is to present CuprIAx services and to facilitate contact with prospective clients. Users undertake to use it lawfully and diligently, and in particular to refrain from:
- Using the Site for unlawful purposes or in a manner contrary to good faith, public order or applicable law.
- Submitting false data, third-party data without authorisation, or impersonating another person or company in the contact forms.
- Attempting to access restricted areas, interfere with the operation of the Site, introduce malicious code, or take any action that compromises its security or availability.
- Systematically extracting, reproducing or reusing the content of the Site, whether manually or through automated processes, without prior written authorisation from CuprIAx.
3. Services, quotes and commercial proposals
Information published on the Site regarding services, methodologies, timelines and capabilities is for information and reference purposes only. It does not constitute a binding offer and does not oblige CuprIAx to provide a service on any particular terms.
All service delivery is governed by the commercial proposal, quote or contract agreed between the parties for the specific project. In the event of any discrepancy between the Site and that document, the latter shall prevail.
Submitting the contact form does not create any contractual relationship: it constitutes solely a request for information or for a quote.
4. Intellectual and industrial property
The Site and all of its elements — including the CuprIAx name and brand, the logo, texts, design, navigation structure, illustrations, icons, animations and source code — are owned by Cupriax SpA or by third parties who have authorised their use, and are protected under Chilean intellectual and industrial property law.
No right of exploitation over these elements is granted to the user. Their reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, without prior express written authorisation from CuprIAx is prohibited.
Ownership of developments delivered to clients is governed by the contract or proposal corresponding to each project.
5. Third-party links and content
The Site may contain links to third-party platforms such as WhatsApp, Instagram or LinkedIn. These links are provided solely as a means of contact or reference.
CuprIAx neither controls nor administers those services and is not responsible for their content, availability or data processing practices. Use of those platforms is governed by their own terms and privacy policies.
6. Availability and continuity
CuprIAx endeavours to keep the Site operational and up to date, but does not guarantee uninterrupted availability or the complete absence of errors. Service may be affected by maintenance, updates, hosting provider failures or events of force majeure.
CuprIAx reserves the right to modify, suspend or discontinue the Site or any of its sections, in whole or in part and at any time, without this giving rise to any right to compensation.
7. Liability
CuprIAx shall not be liable for damages arising from the use of the Site or the inability to use it, nor for decisions taken by users on the basis of the reference information published there.
Users are responsible for having adequate technical means to access the Site securely, including up-to-date software and protection against malicious programs.
The above is without prejudice to any liability that the law imposes on a non-waivable basis and to the rights granted to consumers under Chilean Law No. 19,496 on Consumer Protection.
8. Personal data protection
The processing of personal data provided by users through the Site is governed by the Privacy Policy, which forms an integral part of these Terms and Conditions and can be consulted via the link at the foot of this page.
9. Amendments
CuprIAx may amend these Terms and Conditions where it deems necessary, for example to align them with legal changes or new features of the Site. The version in force will always be the one published on this page, showing its last update date.
We recommend reviewing this document periodically. Continued use of the Site after an amendment implies acceptance of the updated version.
10. Governing law and jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Chile.
For any dispute arising from their interpretation or application, the parties submit to the jurisdiction of the ordinary courts of justice of the city of Calama, without prejudice to a consumer's right to bring proceedings before the court designated by law.
